A recent HSE prosecution has once again highlighted the devastating consequences of inadequate scaffold safety.
Mr Iftikhar Ahmed Mughal, aged 64, died four days after falling from a scaffolding tower without edge protection while fitting a shop sign in Darwen, Lancashire, on 22 November 2022.
He was standing on a platform just six feet high when he fell to the pavement below. The fall caused serious head injuries, and despite emergency care, Mr Mughal sadly passed away in hospital a few days later.
An investigation by the Health and Safety Executive (HSE) found that both WH Metals Limited and its director, who was present at the time, had failed to prevent the risk of a fall from height—a fundamental breach of duty under the Health and Safety at Work etc. Act 1974.
A Preventable Death
The court heard that the scaffold tower had no guardrails or edge protection in place. The HSE stated that this simple, well-known safety measure would almost certainly have prevented the fatal fall.

HSE guidance on tower scaffolds clearly specifies that guardrails around working platforms are the preferred method of fall prevention, a requirement that all competent scaffolders and supervisors are trained to recognise and implement.
At Bolton Magistrates’ Court, WH Metals Limited pleaded guilty to breaching Section 2(1) of the Act and was fined £45,000 plus costs. The company’s director, Mr Waqas Hanif, pleaded guilty under Section 37 and received a 26-week suspended custodial sentence alongside additional costs.
